Mental Capacity Law

Rosie has a particular interest in Court of Protection welfare cases including deprivation of liberty and best interests proceedings. Rosie has a great deal of experience in representing the relevant person’s representative (RPR), the patient directly (directly or through a litigation friend), and family members of the patient in section 21A Mental Capacity Act 2005 proceedings that challenge the patient’s deprivation of liberty. Rosie also has experience in representing the patient (directly or through a litigation friend) and family members of the patient in section 16 Mental Capacity Act 2005 best interests proceedings.

Community Care

Rosie has much experience in liaising and litigating with
local authorities in order to ensure the client is receiving the correct package of care. Rosie’s work has included obtaining and challenging care needs assessments in accordance with the Care Act 2014 and securing section 17 and section 20 Children Act 1989 status for eligible clients.


Memberships

Rosie is the South West Court of Protection Practitioners Association (SW COPPA) regional representative for both Truro and Plymouth. Rosie is also a Cornwall Law Society committee member and the social media representative for Cornwall Junior Lawyers Division.
